Hi jack,

Back about a month a 2 ago I got my questioner, I just had my 3 year
anniversary in Oct 2008. I filled the questioner out and sent it in and
today I got a letter that says,

"We sent you a letter telling you that we were going to review your
disability case. However we do not need to review your case at this time.
Therefore we will not contact your doctor now. We will keep any information
that you have given us. we will contact you later if we need to review your
case."

Then it gives me things to remember.

I know what this means, it means that they do not need to review my case now
but in the world of the Social Security Dept. what does this letter mean?
Will I get another letter at anytime or am I OK for another 3 years ?

In CDR deferrals, if it was straight SSDI and no work activity was
involved, the instructions to coding clerks tell them to reset the
diary date in the system for the same amt. of time as your most recent
call-up, in your case, three years.

The profile sheet, the MEDICAL RE-EXAM REASON section on the Query
Medical Information Data (QMID) screen on the DCF, the MR entry on the
SSR, and the first field in the second scanline on the scannable form
SSA-455-OCR-SM contain this information. There may be multiple QMID
screens; typically, the most recent iteration is used.

In the event the diary types do not agree, use the diary type on the
profile sheet in the OD-CALC MDR: field. The diary type on the profile
sheet reflects the most accurate on-line information regarding the
diary type that was set at the CPD.

The DCF QMID, SSR MR, and scanline information may be less accurate as
a result of missing or intervening systems entries, but should be used
if no value is provided on the profile sheet or the mailer.

In the event that no MDR/MR is provided on any database, use the
default MDR/MR of “3”.

The following diary types and corresponding duration apply:

MIE = reset for 18 months;

MIP = reset for 3 years;

MINE = reset for 7 years.

Some MINE cases have 5-year diaries. Reset these MINE diaries for 5
years.

Do not reset or attempt to substantively change the diary type using
current instructions in DI 26525.000.

Hi Jack,

I know you can't do anything about this but maybe you can give me some
insight. In your last reply you mentioned the diary types, the reason I
didn't leave the last post in this on is because my question relates to it
but in a way really doesn't.....lol

From Oct 2005 when I was approved for Social Security Disability I have
tried to find out what diary type I was, I called my local office to find
out because none of my paperwork had anything about diary type. The local
office couldn't find it either and left me still wondering.

Oct of 2008 was my 3 year date and in Feb of 2009 I got the questioneer
which I filled out and sent in and they send me back the letter saying,

"We sent you a letter telling you that we were going to review your
disability case. However we do not need to review your case at this time.
Therefore we will not contact your doctor now. We will keep any information
that you have given us. we will contact you later if we need to review your
case."

I understand that you told me the clerk are told to reset the date to the
original diary type which I assume is 3 year for me from your advice. Still
wondering I called the national office and once again I was told that there
was no diary type on my record, the woman asked me what I was worried about
I was getting my benefits, I told her I wasn't worried I just wanted to
understand and know for sure what my diary type was. She then told me I
didn't have one "yet" she said I would most likely get one after my first
review. I asked her when that would be now that I got the letter saying I
wasn't going to have a review at this time, once again she couldn't give me
a answer. It got to the point that she was giving me such short answers I
felt I was asking things I shouldn't be so I stopped. I don't want to cause
any red flags just because I want to know what I feel I have a right to know
and that is what diary type I am for sure.

The way she made me feel is that the local office was "most likely very busy
at this time" but when they are not busy I could be sent a review letter at
any time.

I just hate not knowing..

When your initial determination was made in 2005, your diary due date
was entered in item 17 of this form:

Based on the dates you provided, you were most likely a MIP (3-year
call up).

You had a deferral rather than a CDR. Unless your deferral action was
complicated and required review by a disability examiner, it was
handled by a clerk. That's probably what happened with your deferral.
The clerk is instructed to use the same diary coding as the previous
determination, in your case, three years. This means that the system
will pull up your case in three years. SSA has the option at that
time of sending you another CDR mailer short form, sending you a long
form to start an actual CDR, or, if they are busy with initial cases,
putting you on the back burner.

When you have an actual CDR, SSA is supposed to tell you when the
system will call up your case again, but even then in many instances
they overlook this requirement. They're very lax these days when it
comes to notifications.

Now that SSA has entered the electronic age big time, they often have
more trouble disseminating information than they did in the past. Go
figure. Back in the day, they would simply retrieve your paper folder
and look at the entries on the hard paper copies for the information
requested.

I wouldn't keep pestering SSA for this info, but would assume that the
system has been triggered for a 3-year call up.
