Hi, my neighbor has let me use his computer so I can ask if anyone can
any tell me is there anyway to get my benefits faster I've been
determined fully favorable back on 19 Oct 09. My claim was started
back in Nov 07. Denied first to stages (due to SSA mix up of cases,
i.e., mine with another gentleman's and never would fix their error,
had to go to hearing to set record straight) As soon as I walked into
hearing both the Judge and Job Specialist knew I was fully disabled,
and hearing itself was very very short. This was back on 2 Sep 09. My
lawyer (hah, a joke) just tells me to be patient. However, because of
the long delay (again due to SSA error) our finances have been tough
just paying the mortgage, now we have judgements against us from other
creditors and have now put a lien on our bank account. They took all
our money from checkings and what little there was in savings. We have
no money for anything, food, clothes, etc. Not to mention the house
is in decay, we haven't been able to fix broken window, only with tape
and cardboard, due to my illnesses, I fall often, and have a broken
toliet that we can't afford to replace yet, other numerous problems.
Is there anyway to get the Payment Processing Center to process my
benefits faster? We are desperate, we have to borrow money for gas
for my wife to get to work. If anyone can please help with guidance
or advice, would be truly appreciated.

It has been more than three months. This delay is unconscionable
unless the case was picked-up for quality review.

You can contact the local office, allege dire need, and request that
your case be flagged as "critical case/dire need" but the reality
is that in over half of these cases actual payment is no faster.
Still, I would allege dire need. The case may have fallen through the
cracks.

completed and sent to the PC.

I've had that problem too. Finally, I got fed up and decided that it was
simpler to just go out and get a job rather than depend on handouts from
the government.

I see Jack has addressed your issue with the delay in getting your benefits
started. I'm going to address some of your other issues.

Some advice for you. 1) Have a separate bank account for your SSDI check if
you plan on depositing the money in a bank. If you co-mingle it with your
spouse's, it can be seized by creditors. 2) I assume you don't have a
computer, so perhaps your neighbor can help with this, or you have access to
a public library or nearby university with a computer lab? Go to the
following link;

or http://tiny.cc/y2VJP

and scroll to the bottom and click the link that says "Declaration of
Defendant Regarding Income and Assets Exempt from Garnishment" You will
need to change the form where it says Washinton, to whatever state YOU live
in.

Send a copy to any creditors that obtained judgements against you, and any
currently attempting to collect a debt by litigation. By law, they cannot
seize or garnish your SSDI benefits. This is why you need to keep your SSDI
funds separate from your wife's income, as hers is garnishable, and they can
freeze her account. If you co-mingle, they cannot tell what is SSDI, and
what is not. If you don't do this, once you do receive your funds, the
creditors will seize them immediately, and then you will have to fight to
get them restored to you.

I do not know your present income, but have you applied for Food Stamps? You
may also get energy Assistance from your state in the form of Fuel
Assistance (Oil, Gas, Kerosene, Electric) and sometimes Electricity
Assistance. Many states have a WRAP program if you get Energy Assistance.
Your window would be a covered item under the WRAP program, and may be
repaired/replaced at no cost to you. You may want to explore what
non-profits are available in your area, and see if you can get some help
from any of them for house repairs. Any repairs that would be related to
making your home energy-efficient and hold heat in the winter (storm
windows/doors, caulking, insulation, etc.) would be covered under your
county WRAP program.

For example, I get assistance from two area non-profits. One has provided me
with a mobility scooter, the other provides a grant which pays for my
housekeeoing services. They are out there, but you need to do a little
leg-work to find them and what services they offer. In the case of the one
who pays my housekeeper, a benefactor funds the grant.

There is not a thing that I am aware of that can be done with the
reasonable expectation that it will hasten the arrival of benefits.
Waiting is all you can do.
Merry Christmas!
